1. Introduction
These Terms & Conditions govern the provision of private hire taxi services by Local Eccleshill Premier ("we", "us", "our"). By booking or using our services, you ("the customer", "you") agree to be bound by these terms.
2. Booking and Contract
1. A booking is accepted when confirmed by us via telephone, website, mobile app, email, or other approved communication method.
2. All journeys are subject to vehicle and driver availability.
3. We reserve the right to refuse or cancel a booking where necessary for safety, legal, operational, or regulatory reasons.
3. Fares and Payment
1. Fares are charged according to our current tariff or agreed quotation
2. Additional charges may apply for waiting time, airport fees, tolls, parking charges, congestion charges, extra pick-up/drop-off points, excessive cleaning, or damage caused by passengers.
3. Payment may be made by cash, card, account, or other accepted payment methods.
4. Where card payments are taken, additional verification may be required.
4. Waiting Time
1. Waiting time may be charged after a reasonable grace period.
2. For airport collections, waiting time may be charged from the scheduled landing time plus any applicable grace period.
5. Cancellations
1. You may cancel a booking before the driver is dispatched without charge, unless otherwise stated.
2. A cancellation fee may apply if the booking is cancelled after dispatch, after the driver has arrived, or within a specified period before the pick-up time.
3. No-show charges may apply if the passenger cannot be contacted or fails to meet the driver within a reasonable time.
6. Passenger Responsibilities
1. Provide accurate booking information.
2. Be ready at the agreed pick-up time and location.
3. Behave in a safe, respectful, and lawful manner.
4. Ensure children use appropriate child restraints where legally required.
5. Take reasonable care of the vehicle and its contents.
7. Luggage and Property
1. Passengers are responsible for ensuring luggage is suitable for transport.
2. We may refuse items that are excessively large, dangerous, illegal, or unsuitable for carriage.
3. We are not responsible for loss of or damage to luggage or personal belongings unless caused by our negligence.
8. Lost Property
1. We will make reasonable efforts to locate property left in a vehicle.
2. Recovered items may be subject to a handling or delivery charge.
3. Unclaimed property may be disposed of in accordance with applicable law and company procedures.
9. Delays and Service Availability
We will use reasonable efforts to provide timely service, but we are not liable for delays caused by traffic, weather, road closures, accidents, vehicle breakdowns, public events, or other circumstances beyond our reasonable control.
10. Limitation of Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.
Subject to the above:
1. Our liability for any loss arising from the use of our services is limited to the amount paid for the relevant journey.
2. We are not liable for indirect, consequential, or economic losses, including missed flights, trains, appointments, or business opportunities, except where caused by our negligence and not excludable by law.
11. Complaints
Any complaints should be submitted as soon as possible after the journey using the contact details provided above. We will investigate complaints and respond within a reasonable timeframe.
12. Privacy
Personal information is handled in accordance with our Privacy Policy.
13. Governing Law
These Terms & Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to Terms
We may update these Terms & Conditions from time to time. The latest version will be available on our website or upon request.
